TERMS & CONDITIONS

By the act of sending a deposit (or full) payment to Operadora Happy Gringo Cia Ltda you are confirming your acceptance of the Terms and Conditions listed below, for yourself and for each member of your travel party, no signature(s) is (are) necessary.

Happy Gringo would also like to state that, while both we and our clients are bound by the legal contract below, we will always do everything possible to help and support our clients in the event of any pre-tour or on-tour issues – in fact we have an envied reputation of going above and beyond to help our clients out. We are also able to assist with any necessary documentation for your insurance claims.

ENGLISH VERSION

FIRST CLAUSE – PARTICIPANTS

  • 1.1 The company OPERADORA HAPPY GRINGO Cia. Ltda., legally represented by Mrs. Eva Merkx, from here on and for the effect of this contract will be called the “AGENCY”.
  • 1.2 The person contracting the services of THE AGENCY from here on will be called the “TOURIST”.
  • 1.3 The third party company who operate the tour from here on will be called the “OPERATOR”.

SECOND CLAUSE - OBJECTIVE OF THE CONTRACT

THE TOURIST contracts the AGENCY to provide the necessary advisory service, contacts and reservations with tourism OPERATORs in order to travel and participate in the activities at the destinations chosen by the TOURIST.

THIRD CLAUSE - OBLIGATIONS OF THE PARTIES

THE AGENCY:
  • 3.1 To provide the best OPERATORs in the market relative to the established price. The OPERATORS must be legally established and authorized to operate in agreement with Ecuadorian law.
  • 3.2 To provide all of the necessary information that the tourist will require about his/her contracted travel destination / tour.
  • 3.3 To provide THE TOURIST with all tickets and vouchers required for participation on the tour.
  • 3.4 To contact the family, insurance company and / or embassy of the TOURIST in case of accident caused by acts of providence or force majeure. The AGENCY is not responsible for injuries, death or any other damage caused under any circumstances by the TOURIST or OPERATOR.
THE TOURIST:
  • 3.5 To have clearly understood and accepted the risks that travel inside of Ecuador implies. This includes the risks of injury or death associated with force majeure or acts of providence such as wars, internal commotion, protests / strikes, terrorism, fire, natural disasters, public authority decisions, any form of accident, or any other extreme and unforseen circumstances. Also the risks that exist in the practice of extreme sports including but not restricted to mountain biking, rafting / tubing, climbing, mountain sports, trekking, camping, rappelling / canopy ziplining, horse-riding, snorkelling, diving and any other activity or sport where there is contact with nature. The TOURIST accepts that the AGENCY will not be held responsible for loss, injury or damage to person or property for any of the above causes.
  • 3.6 To hold valid and comprehensive travel insurance covering the booked travel dates, or, in the absence of such an insurance policy and having no intention of obtaining one, to declare the AGENCY exempt of all responsibility for any kind of accident, death, injury or physical problem that occurs during the contracted trip, as well as any financial responsibilty due to trip cancellation or curtailment, loss of luggage, trip delays, medical coverage, emergency evacuation or repatrition or any other inconveniences outside of the control of the AGENCY.
  • 3.7 To have all immigration documents, valid passport and vaccinations necessary to travel according to Ecuadorian law.
  • 3.8 To communicate to the AGENCY in advance, details of any kind of special food requirement, disability or sickness that exists at time of travel.
  • 3.9 To be in sufficient good health and fitness to take part in the trip that is reserved.In the case of visiting high altitude destinations it is the responsibility of the TOURIST to be sufficiently aclimatized to perform the visit safely.
  • 3.10 To provide all passenger data and passport copies as requested by the AGENCY, and to authorise the AGENCY to pass personal data onto the OPERATOR as required.

FOURTH CLAUSE – TOUR PAYMENT

  • 4.1 A 40% deposit payment is required to the AGENCY within a maximum period of 1 week (7 days) from the original booking date. In cases where a reservation is made less than 91 days prior to trip departure then full tour payment is required within 1 week (7 days) of the original booking date.
  • 4.2 The full balance of the tour fare must be paid no later than 90 days prior to the tour departure date, otherwise the AGENCY may treat the booking as being cancelled by the TOURIST and apply cancellation charges as set out in clause six. Tickets can only be issued to the TOURIST once full payment has been received by the AGENCY.
  • 4.3 The AGENCY will only request and accept bank payments that are made into our official corporate accounts under the name of OPERADORA HAPPY GRINGO CIA LTDA. The AGENCY will never request, accept or recognise any payments that have been made into any other third party bank account. 

FIFTH CLAUSE – CONFIRMATION OF TOUR

  • 5.1 The TOURIST’s reservation is legally confirmed by the AGENCY only after receipt of either the 40% deposit payment, or the full tour payment from the TOURIST as per Clause 4.
  • 5.2 The AGENCY agrees to make all necessary payments to local OPERATORS in a timely manner, to ensure the correct reservation and operation of the tour.

SIXTH CLAUSE - TOUR CANCELLATION BY THE TOURIST

  • 6.1 Cancellations by the client must be made in writing and will only be effective once the agency is in receipt of the written document.
  • 6.2 If the TOURIST cancellation is received 120 days or more in advance of the trip start date, a penalty fee of 25% of the total tour value will be charged per person.
  • 6.3 If the TOURIST cancellation is received between 91 and 119 days before the start of the trip, a penalty fee of 40% of the total tour value will be charged per person.
  • 6.4 If the TOURIST cancellation is received 90 days or less before the start of the trip, the TOURIST will forfeit 100% of the total tour value.
  • 6.5 The following Galapagos cruises are subject to alternative cancellation fees: Angelito, Daphne, Grand Queen Beatriz, Eden, Monserrat I, Xavier, Yolita II, Samba, Seaman, Sea Star Journey, Santa Cruz II, Isabela II, La Pinta, Letty, Origin, Theory, Darwin, Aggressor III, Humboldt Explorer. For cruises booked on any of these vessels clauses 6.2, 6.3 and 6.4 will not apply – Please ask our sales team about the alternative cancellation fee schedule. It is the responsibility of the TOURIST to ask about the specific cancellation terms before booking.
  • 6.6 GALAPAGOS CHARTERS: Charter cruise cancellation terms may differ to the regular cancellation terms listed in clauses 6.2 to 6.5. For charter bookings it is the responsibility of the TOURIST to check with the AGENCY prior to booking.
  • 6.7 TRIP CANCELLATION INSURANCE: The AGENCY strongly recommends the purchase of Cancel For Any Reason (CFAR) trip cancellation insurance covering THE TOURIST for fees and losses in case of tour cancellation.
  • 6.8 TRIP POSTPONEMENT: In the case of a request for postponement of the tour by the TOURIST, the above cancellation fees will still apply, unless the OPERATOR agrees to forfeit the fee.

SEVENTH CLAUSE – FORCE MAJEURE

  • 7.1 The OPERATOR reserves the right to cancel or modify the tour due to force majeure, acts of providence, extraordinary or unforeseen events, or circumstances beyond the control of the AGENCY that prevent the OPERATOR from providing the contracted service. Such events include but are not limitied to: epidemic, pandemic, war or revolution, strikes / riots / civil unrest, extreme weather, floods, tsunami, earthquake, volcanic eruption, fire, drought, contamination, legislation or decision by government or state powers that prohibit or impact the performing of a tour, energy blackouts, cyber attacks, threat of or acts of terrorismwars, internal commotion, protests / strikes, terrorism, fire, natural disasters, or public authority decisions.
  • 7.2 In the event of such cases as described in clause 7.1, the AGENCY will offer either an alternative tour with comparable service, or a change of date for the originally booked tour, but is under no obligation to provide a refund to the client.

EIGHTH CLAUSE - TOUR ALTERATION

  • 8.1 The OPERATOR and the AGENCY reserve the right to vary the time of day of its tour departures, or alter tour programs and itineraries without advance notice for reasons including but not limited to: changing weather and the forces of nature, wildlife behavioural habits, vehicle or yacht safety, passengers or crew safety, the discretion of your guide, driver or public authorities. Under the aforementioned conditions, the AGENCY is under no obligation to provide a substitution, replacement of services or refunds to the TOURIST.
  • 8.2 The AGENCY reserves the right to alter the price of a tour even after full payment has been received from the TOURIST in such cases where decisions by a third party – which could include the tour operating company, the Ecuadorian government, the Ecuadorian tax authorty or other parties – cause the original price of the service to unexpectedly increase.

NINTH CLAUSE - TRANSPORTATION TO THE TOUR ASSEMBLY POINT

9.1 The TOURIST is responsible for making his or her own arrangements to arrive at the tour assembly point. There are no arrangements in existence should the TOURIST be delayed at the outward or homebound points of departure.

TENTH CLAUSE - COMPLAINTS PROCEDURE AND REFUNDS

  • 10.1 If the TOURIST experiences a problem during the tour then they should inform Happy Gringo immediately and in writing – only complaints that are brought to the attention of the AGENCY within a maximum period of 1 week after finishing the tour will be handled. The AGENCY will endeavour to formally respond fully to all complaints within 1 week of receiving notification, although delays in receiving adequate information from operators may impact AGENCY response time.
  • 10.2 The TOURIST understands and acknowledges that THE AGENCY is contracted by them as a third party, and that the TOURIST’s payment is paid on to third party service providers in order to confirm the requested travel services of the TOURIST. The TOURIST agrees and authorizes the AGENCY to act on their behalf in this way, and to use payments received from the TOURIST to confirm said travel services. The TOURIST understands that the AGENCY cannot be held responsable for those funds paid to a third party operator to secure tour services. Neither can the TOURIST reclaim those funds from the AGENCY by means of credit card chargebacks, lawsuits, or other means. In the case of tour cancellation or complaints, the AGENCY will do everything possible to recover funds from the third party operator to pass onto the CLIENT as a refund, but cannot be held responsable in the case that terms and conditions of the third party prevents successful recovery.
  • 10.3 The AGENCY will not be responsible for giving refunds in any of the following situations:
    • Mechanical issues affecting any form of transport on the trip.
    • Substitution of facilities or personnel.
    • Late arrival or no-show of THE TOURIST.
    • Decision of THE TOURIST to leave the tour early or miss any activities / meals / accommodations during the tour.
    • Issues caused by the TOURIST travelling without necessary documentation including passport, visas, immigration papers or vaccination certificates.
    • Price differences paid by different passengers aboard the same tour including special last minute rates.
    • Decisions by any third party that affect the normal running of the tour including by THE OPERATOR, Ecuadorian government or National park authority.
    • Force Majeure events or any other extraordinary circumstances as described in Clause Seven.
    • Alteration of trip itinerary or program by the OPERATOR either before or after departure, as described in Clause Eight.
    • Decision of the TOURIST to travel without valid travel insurance, despite the recommendations of the AGENCY in clauses 3.6 & 6.7.
    • Any other circumstances arising beyond THE AGENCY’s control.

ELEVENTH CLAUSE – SPECIAL LIABILITY RELEASE

  • 11.1 The AGENCY, including its employees, agents, contractors, guides, associates, directors, officers and shareholders, gives notice that many of the services it provides, including transportation, hotels and other forms of accommodations, restaurants, and other services, are often purchased from various independent suppliers (OPERATORs). While the AGENCY seeks to work with the best suppliers available, the AGENCY only has a limited ability to control the operations of these suppliers. Each of these suppliers is subject to the laws of Ecuador and their liability may be limited by their tariffs, conditions of carriage, tickets, vouchers, international conventions, and agreements. The TOURIST releases the AGENCY from any and all claims of loss or damage to baggage or property, for personal injuries or death, for loss or delay arising out of the act, omission or negligence of any independent contractors or third party supplier such as air carriers, cruise operators, hotels restaurants, transportation providers, guides and other services or facilities.

TWELTH CLAUSE - INFORMATION & COMMUNICATION  

  • 12.1 All information provided by the AGENCY is given in good faith and is based on the latest information available at the date of publication.
  • 12.2 All communications from AGENCY to TOURIST will be made from official email accounts using the happygringo.com domain. The AGENCY does not accept responsibility for any emails sent to the TOURIST from personal email accounts, or under any other domain name.  

THIRTEENTH CLAUSE - ACCEPTANCE AND DURATION OF THE CONTRACT

  • 13.1 The contract exists from the moment the AGENCY receives either deposit or full payment from the TOURIST, up until completion of the tour that has been contracted. Payment to the AGENCY by the TOURIST of either deposit or full payment means that the TOURIST is in agreement with all clauses in this contract.
  • 13.2 Anything not stipulated directly under this contract will be governed under current Ecuadorian Tourism Law at the date of the present contract.

FOURTEENTH CLAUSE- JURISDICTION & PROCESS

  • 14.1 In case of controversy the parties will submit to the civil judges of the city of Quito and the Ecuadorian Civil Code Procedure.

TÉRMINOS Y CONDICIONES

Al enviar un depósito (o pago completo) a Operadora Happy Gringo Cia Ltda, usted confirma su aceptación de los Términos y Condiciones que se enumeran a continuación, esto es válido tambien para usted y para cada miembro de su grupo de su tour, es un contrato valido y no requiere firma.

Happy Gringo también quisiera declarar que, si bien tanto nosotros como nuestros clientes estamos obligados por el contrato legal a continuación, siempre haremos todo lo posible para ayudar y apoyar a nuestros clientes en caso de que se presente algún problema problema previo al viaje o en el tour, es algo que se demuestra con nuestra excelente reputación.

También podemos ayudarlo con la documentación necesaria para sus reclamos de su seguro de viaje personal.

VERSION ESPAÑOL

PRIMERA CLÁUSULA - PARTICIPANTES

  • 1.1 La empresa OPERADORA HAPPY GRINGO Cia. Ltda., Legalmente representada por la Sra. Eva Merkx, de aquí en adelante y para el efecto de este contrato se llamará "AGENCIA".
  • 1.2 La persona que contrate los servicios de LA AGENCIA de aquí en adelante se denominará "TURISTA".
  • 1.3 La compañía de terceros que opera el recorrido de aquí en adelante se llamará "OPERADOR".

SEGUNDA CLÁUSULA - OBJETIVO DEL CONTRATO

EL TURISTA contrata a la AGENCIA para proporcionar el servicio de asesoramiento, contactos y reservas necesarios con los OPERADORES de turismo para viajar y participar en las actividades en los destinos elegidos por el TURISTA.

TERCERA CLÁUSULA - OBLIGACIONES DE LAS PARTES

LA AGENCIA:
  • 3.1 Para proporcionar los mejores OPERADORES en el mercado en relación con el precio establecido. Los OPERADORES deben estar legalmente establecidos y autorizados para operar de acuerdo con la ley ecuatoriana.
  • 3.2 Proporcionar toda la información necesaria que el turista requerirá de su viaje / destino de viaje contratado.
  • 3.3 Proporcionar al TURISTA todas las entradas y vales necesarios para participar en el recorrido.
  • 3.4 Contactar a la familia, compañía de seguros y / o embajada del TURISTA en caso de un accidente causado por actos de  fuerza mayor. La AGENCIA no se hace responsable por lesiones, muerte o cualquier otro daño causado bajo ninguna circunstancia por el TURISTA o el OPERADOR.
EL TURISTA
  • 3.5 Haber entendido y aceptado claramente los riesgos que implica viajar dentro del Ecuador. Esto incluye los riesgos de lesiones o muerte asociados con fuerza mayor o actos de providencia como guerras, conmociones internas, protestas / huelgas, terrorismo, incendios, desastres naturales, decisiones de la autoridad pública, cualquier forma de accidente o cualquier otro imprevisto o circunstancia. Además, los riesgos que existen en la práctica de deportes extremos ciclismo de montaña, rafting / tubing, escalada, deportes de montaña, trekking, camping, rappel / tirolesa, equitación, snorkel, buceo y cualquier otra actividad o deporte donde hay contacto con la naturaleza. El TURISTA acepta que la AGENCIA no se hace responsable de la pérdida, lesiones o daños a personas o bienes por cualquiera de las causas anteriores.
  • 3.6 Mantener un seguro de viaje válido e integral que cubra las fechas de viaje reservadas o, en ausencia de dicha póliza de seguro declarar a la AGENCIA exenta de toda responsabilidad por cualquier tipo de accidente, muerte, lesión o problema físico que ocurre durante el viaje contratado, así como cualquier responsabilidad financiera debido a la cancelación o reducción del viaje, pérdida de equipaje, demoras en el viaje, cobertura médica, evacuación o repatriación de emergencia o cualquier otro inconveniente fuera del control de la AGENCIA.
  • 3.7 Tener todos los documentos de inmigración, pasaporte válido y las vacunas necesarias para viajar de acuerdo con la ley ecuatoriana.
  • 3.8 Comunicar a la AGENCIA con anticipación, detalles de cualquier tipo de requisito especial de alimentos, discapacidad o enfermedad que exista en el momento del viaje.
  • 3.9 Tener buena salud y buena forma física para participar en el viaje reservado. En el caso de visitar destinos de gran altitud, es responsabilidad del TURISTA estar suficientemente aclimatado para realizar la visita de manera segura.
  • 3.10 Proporcionar todos los datos de pasajeros y copias de pasaportes según lo solicitado por la AGENCIA, y autorizar a la AGENCIA a pasar datos personales al OPERADOR según sea necesario.

CUARTA CLÁUSULA - PAGO DEL TOUR

  • 4.1 Se requiere un depósito del 40% a la AGENCIA dentro de un período máximo de 1 semana (7 días) a partir de la fecha de reserva original. En los casos en que se realice una reserva con menos de 91 días antes de la salida del viaje, se requiere el pago completo del tour dentro de 1 semana (7 días) de la fecha de reserva original.
  • 4.2 El saldo total de la tarifa del tour debe pagarse a más tardar 90 días antes de la fecha de salida del tour, de lo contrario, la AGENCIA puede tratar la reserva como cancelada por el TURISTA y aplicar los cargos de cancelación como se establece en la cláusula seis. Los boletos solo pueden emitirse al TURISTA una vez que la AGENCIA haya recibido el pago completo.
  • 4.3 La AGENCIA únicamente solicitará y aceptará pagos bancarios que se realicen a nuestras cuentas corporativas oficiales a nombre de OPERADORA HAPPY GRINGO CIA LTDA. La AGENCIA nunca solicitará, aceptará o reconocerá ningún pago que se haya realizado en cualquier otra cuenta bancaria de un tercero.

QUINTA CLÁUSULA - CONFIRMACIÓN DEL TOUR

  • 5.1 La reserva del TURISTA será legalmente confirmada por la AGENCIA solo después de recibir el pago del depósito del 40% o el pago completo del tour del TURISTA según la Cláusula 4.
  • 5.2 La AGENCIA se compromete a hacer todos los pagos necesarios a los OPERADORES locales de manera oportuna, para garantizar la reserva correcta y la operación del recorrido.

CLÁUSULA SEXTA - Cancelaciones de Itinerarios

  • 6.1 Las Cancelaciones hechas por el cliente deben ser notificadas por escrito y solo serán efectivas una vez que la Agencia haya recibido el documento.
  • 6.2 Si la cancelación del TURISTA es recibida a partir de 120 días o antes de iniciado el viaje, se tendrá una penalidad del 25% del valor total por persona del tour.
  • 6.3 Si la cancelación del TURISTA es recibida entre 91 a 119 días antes del inicio del viaje,  implicará una penalidad del 40% del valor total del tour por persona del tour.
  • 6.4 Si la cancelación del TURISTA se recibe 90 días o menos antes del inicio del viaje, el TURISTA perderá el 100% del valor total del tour.
  • 6.5 Los siguientes cruceros por Galápagos están sujetos a tarifas de cancelación alternativas: Angelito, Daphne, Grand Queen Beatriz, Eden, Monserrat I, Xavier, Yolita II, Samba, Seaman, Sea Star Journey, Santa Cruz II, Isabela II, La Pinta, Letty, Origen, Teoría, Darwin, Aggressor III, Humboldt Explorer. Para cruceros reservados en cualquiera de estos buques, cláusulas 6.2, 6.3 y 6.4 no se aplicarán; consulte el programa de tarifas de cancelación alternativa. Es responsabilidad del TURISTA verificar los términos específicos de cancelación antes de reservar.
  • 6.6  Cruceros Charter Galapagos: Los términos de cancelación del crucero chárter pueden diferir de los términos de cancelación regulares enumerados en las cláusulas 6.2 a 6.5. Es responsabilidad del TURISTA consultar con la AGENCIA antes de reservar.
  • 6.7 SEGURO DE CANCELACIÓN DE VIAJE: La AGENCIA recomienda la compra de un seguro privado de  cancelación de viajes( CFAR) que cubra al EL TURISTA para tarifas y pérdidas en caso de cancelación del viaje.
  • 6.8 APLAZAMIENTO DEL VIAJE: En el caso de una solicitud de aplazamiento del recorrido por parte del TURISTA, las tarifas de cancelación mencionadas en los ítems anteriores se aplicarán, a menos que el OPERADOR del tour llegue a un acuerdo.

SÉPTIMA CLÁUSULA - FUERZA MAYOR

  • 7.1 El OPERADOR se reserva el derecho de cancelar o modificar el recorrido debido a fuerza mayor, eventos extraordinarios, imprevistos, o circunstancias fuera del control de la AGENCIA que impiden que el OPERADOR brinde el servicio contratado. Dichos eventos incluyen, entre otros: epidemia, pandemia, guerra o revolución, huelgas / disturbios / disturbios civiles, clima extremo, inundaciones, tsunami, terremotos, erupciones volcánicas, incendios, sequías, contaminación, legislación o decisión del gobierno o poderes estatales que prohíban o impacten  la realización del tour, apagones energéticos, ciberataques, amenazas o actos de terrorismo, guerras, conmociones internas, protestas / huelgas, terrorismo, incendios, desastres naturales o decisiones de la autoridad pública.
  • 7.2 En el caso de los casos descritos en la cláusula anterior,  la AGENCIA ofrecerá un recorrido alternativo con un servicio comparable o un cambio de fecha para el recorrido reservado originalmente, pero no tiene la obligación de proporcionar un reembolso al cliente.

CLÁUSULA OCTAVA - ALTERACIÓN DEL TOUR

  • 8.1 El OPERADOR y la AGENCIA se reservan el derecho de variar la hora del día de sus salidas del tour, o alterar los programas e itinerarios del tour sin previo aviso por razones que incluyen, entre otras: cambio de clima y las fuerzas de la naturaleza, hábitos de comportamiento de la vida silvestre, vehículo o la seguridad del yate, la seguridad de los pasajeros o la tripulación, a discreción de su guía, conductor o autoridades públicas. Bajo las condiciones antes mencionadas, la AGENCIA no tiene la obligación de proporcionar una sustitución, reemplazo de servicios o reembolsos al TURISTA.
  • 8.2 La AGENCIA se reserva el derecho de alterar el precio de un tour incluso después de que el TURISTA haya hecho el pago completo en los casos en que las decisiones de un tercero afecten el precio, incluido la compañía operadora del tour, el gobierno ecuatoriano, entre otros que hacen que el precio original del servicio aumente inesperadamente.

NOVENA CLÁUSULA - TRANSPORTE AL PUNTO DE ASAMBLEA DEL TOUR

  • 9.1 El TURISTA es responsable de hacer sus propios arreglos para llegar al punto de reunión del tour. No existen arreglos en caso de que el TURISTA se retrase en los puntos de partida hacia el exterior o hacia el hogar.

DÉCIMA CLÁUSULA - PROCEDIMIENTO DE QUEJAS Y REEMBOLSOS

  • 10.1 Si el TURISTA experimenta un problema durante el recorrido, debe informar a Happy Gringo de inmediato y por escrito, solo quejas que se presenten al servicio al cliente de la AGENCIA dentro de un período máximo de 1 semana después de terminar el tour serán tomadas en cuenta. La AGENCIA se esforzará por responder formalmente  todas las quejas dentro de la semana posterior a la recepción de la notificación, aunque las demoras en recibir información de los OPERADORES pueden afectar el tiempo de respuesta de la AGENCIA.
  • 10.2 El TURISTA entiende y reconoce que LA AGENCIA es contratada por él como un tercero, y que el pago del TURISTA se abona a terceros proveedores de servicios con el fin de confirmar los servicios de viaje solicitados por el TURISTA. El TURISTA acepta y autoriza a la AGENCIA para actuar en su nombre de esta manera, y utilizar los pagos recibidos del TURISTA para confirmar dichos servicios de viaje. El TURISTA entiende que la AGENCIA no se hace responsable de los fondos pagados a un operador externo para asegurar los servicios turísticos. El TURISTA tampoco podrá reclamar esos fondos a la AGENCIA mediante devoluciones de tarjetas de crédito, juicios u otros medios. En el caso de cancelación del tour o quejas, la AGENCIA hará todo lo posible para recuperar los fondos del operador externo para pasar al CLIENTE como reembolso, pero no se hace responsable en el caso de que los términos y condiciones del tercero impidan la recuperación con éxito.
  • 10.3 La AGENCIA no será responsable de dar reembolsos en ninguno de los siguientes situaciones:
    • Problemas mecánicos que afectan cualquier forma de transporte en el viaje.
    • Sustitución de instalaciones o personal.
    • Llegada tardía o no presentación de EL TURISTA.
    • La decisión de EL TURISTA de abandonar el recorrido temprano o perderse cualquier actividad / comida / alojamiento durante el recorrido.
    • Problemas causados por viajes TURÍSTICOS sin la documentación necesaria incluyendo pasaporte, visas, documentos de inmigración o certificados de vacunación.
    • Diferencias de precios pagadas por diferentes pasajeros a bordo del mismo recorrido, incluidas tarifas especiales de último minuto.
    • Decisiones de cualquier tercero que afecten el funcionamiento normal del recorrido, incluido EL OPERADOR, el gobierno ecuatoriano o la autoridad del parque nacional.
    • Eventos de fuerza mayor o cualquier otra circunstancia extraordinaria como se describe en la Cláusula Siete.
    • Alteración del itinerario o programa del viaje por parte del OPERADOR antes o después de la salida, como se describe en la Cláusula Ocho.
    • Decisión del TURISTA de viajar sin un seguro de viaje válido, a pesar de las recomendaciones de la AGENCIA en las cláusulas 3.6 y 6.7.
    • Cualquier otra circunstancia que surja más allá del control de LA AGENCIA.

UNDÉCIMA CLÁUSULA - LIBERACIÓN ESPECIAL DE RESPONSABILIDAD

  • 11.1 La AGENCIA, incluidos sus empleados, agentes, contratistas, guías, asociados, directores, funcionarios y accionistas, notifica que muchos de los servicios que brinda, incluido el transporte, hoteles y otras formas de alojamiento, restaurantes y otros servicios, son a menudo comprado a varios proveedores independientes (OPERADORES). Si bien la AGENCIA busca trabajar con los mejores proveedores disponibles, la AGENCIA solo tiene una capacidad limitada para controlar las operaciones de estos proveedores. Cada uno de estos proveedores está sujeto a las leyes de Ecuador y su responsabilidad puede estar limitada por sus tarifas, condiciones de transporte, boletos, vales, convenciones internacionales y acuerdos. El TURISTA libera a la AGENCIA de cualquier reclamo de pérdida o daño de equipaje o propiedad, por lesiones personales o muerte, por pérdida o demora, derivada del acto, omisión o negligencia de cualquier contratista independiente o proveedor de terceros, como compañías aéreas. , operadores de cruceros, hoteles, restaurantes, proveedores de transporte, guías y otros servicios o instalaciones.

DUODÉCIMA CLÁUSULA - INFORMACIÓN & COMUNICACIÓN

  • 12.1 Toda la información proporcionada por la AGENCIA se proporciona de buena fe y se basa en la información más reciente disponible en la fecha de publicación.
  • 12.2 Todas las comunicaciones de la AGENCIA al TURISTA se realizarán desde cuentas de correo oficiales utilizando el dominio happygringo.com. La AGENCIA no se responsabiliza por los correos electrónicos enviados al TURISTA desde cuentas de correo electrónico personales, o bajo cualquier otro nombre de dominio.

TRECEAVA CLÁUSULA - ACEPTACIÓN Y DURACIÓN DEL CONTRATO

  • 13.1 El contrato existe desde el momento en que la AGENCIA recibe ya sea un depósito o el pago completo del TURISTA, hasta la finalización del recorrido que se ha contratado. El pago a la AGENCIA por parte del TURISTA de cualquier depósito o pago total significa que, el TURISTA está de acuerdo con todas las cláusulas de este contrato.
  • 13.2 Todo lo que no esté estipulado directamente en este contrato se regirá por la Ley de Turismo Ecuatoriano vigente en la fecha del presente contrato.

CLÁUSULA CATORCEAVA JURISDICCIÓN Y PROCESO

  • 14.1 En caso de controversia, las partes someterán a los jueces civiles de la ciudad de Quito y el Procedimiento del Código Civil ecuatoriano.
